Rules for the distance sale of goods

General provisions

These Sales Rules (hereinafter referred to as the “Rules”) govern the activities of IP “Samilova Yulia Nikolaevna”, legal entity address: 420081, Republic of Tatarstan, Kazan, st. Alberta Kamaleev Avenue, 1, apt. 208; INN: 165122699717, OGRNIP: 317169000027100 (hereinafter referred to as “Yu. N. Samilova”), associated with the sale of Goods remotely.

By accepting the Rules, the Buyer confirms that he is informed that not all Products posted on the Site are available for Order.

By paying for the Goods in accordance with these Rules, the Buyer confirms his agreement with these Rules.

The Buyer is warned that the warranty period for the Products is 30 calendar days.

The Buyer is warned that Yu. N. Samilova sells the Goods remotely on the territory of the Russian Federation.

These Rules are subject to change or addition at any time at the discretion of Yu. N. Samilov. The current version of the Rules is always available at the link https://luliloona.ru/distance_selling_rules/.

1. Scope

1.1. “Buyer” is a fully capable individual who purchases or plans to purchase Goods on the Site, or by phone/via email, for the purpose of using them exclusively for personal, family, household and other needs not related to business activities.

1.2. “Party” – the Buyer or Yu. N. Samilova. “Parties” – jointly the Buyer and Yu. N. Samilova.

1.3. “Product” is a unit of product sold by Yu.N. Samilova, information about which is posted on Yu.N. Samilova’s Website.

1.4. “Order” - the Buyer’s request for delivery to the address specified by the Buyer of the Products selected on the Site, provided for by these Rules.

1.5. These Rules apply when placing an Order through:

1.5.1. contacting the client center of Samilov Yu. N. by email at Luliloona@mail.ru;

1.5.2. website of Samilov Yu. N., located at https://luliloona.ru/ (hereinafter referred to as the “Site”);

1.6. In connection with the purchase of the Goods, an adhesion agreement is concluded with the Buyer on the conditions set out in the Rules.

1.7. The Goods are provided to the Buyer on the basis of the Buyer’s familiarization with the description of the Goods proposed by Yu.N. Samilova through catalogs, as well as information posted on the Site, which excludes the possibility of the Buyer directly familiarizing himself with the Goods or a sample of the Goods. Information about the Products posted on the Site is an invitation to Yu. N. Samilov to make offers and is not a public offer in the meaning provided for in Part 2 of Art. 437 Civil Code of the Russian Federation. The cost of the Product shown on the Site is approximate. Samilova Yu. N. does not guarantee that at the time of the Buyer’s request, the Product chosen by him will be in stock and can be sold at the specified price.

2. Product information

2.1. The possibility of ordering a specific Product depends on its availability in the warehouse Yu. N. Samilova.

3. Ordering goods

3.1. When ordering goods by phone/email:

• The name of the Product, its cost, quantity, assortment, basic consumer properties, terms of purchase and delivery of the Product are agreed upon by the Parties by telephone and/or via email and confirmed in the Order on the Site.

• When placing an Order, the Buyer informs: last name, first name and patronymic, last name, first name and patronymic of the recipient of the Goods, if the Order is received by a third party, name of the Goods, model, article, material, color, size (if applicable), delivery address, contact telephone, email address.

• In the absence of any of the elements specified in this paragraph of the Rules, the Order is considered inconsistent.

• Upon receipt of the Order from the Buyer, Yu. N. Samilova’s client center creates an Order on the Site and sends to the email address specified by the Buyer a link to the Site page with the completed Order to confirm it. The Buyer, having received a link to the Site, checks the Order, reads the terms of purchase of the Product and, if he agrees with all the terms, confirms it by clicking the “Confirm” button.

• If it is necessary to make changes to the Order, the Buyer contacts the customer center again, after which he is re-sent a link to the Website page with the completed Order for confirmation.

• The moment the offer is sent to Yu. N. Samilov is considered to be the moment the Buyer presses the “Confirm” button. Samilova Yu. N. confirms receipt of the Order by sending a corresponding letter to the email address specified by the Buyer. Confirmation of receipt of the Order does not constitute an offer, acceptance, confirmation of acceptance of the Order, or confirmation of the availability of the Goods.

• At the Buyer's request, instead of a link to the Site page to confirm the Order, he may be sent an email with a description of the Order and details of Yu. N. Samilov for payment by bank transfer, as well as links to the relevant sections of the Site, where he can familiarize himself with these Rules, as well as the Public Policy for the Processing of Personal Data Yu. N. Samilova.

• Confirmation of the terms of purchase and delivery of the Goods from the email address provided by the Buyer when contacting the customer center, including by paying for the Order using the bank details sent by Samilov Yu.N., is considered proper confirmation by the Buyer of consent to the terms of purchase of the Goods, and does not require additional verification from Samilov Yu. N..

• Acceptance of the Order by Yu. N. Samilov occurs only after confirmation of the availability of the Goods and sending the Buyer a corresponding email confirming acceptance of the Order. If the information about the Products displayed on the Site does not correspond to reality, as well as in other cases at the discretion of Yu.N. Samilova, Yu.N. Samilova reserves the right not to accept the Order and not to send an offer to the Buyer.

3.2. When Ordering Products through the Site:

• All steps required to place an Order are described in detail on the Site.

• Before submitting the Order, the Buyer can review the selected Products, check the total cost of the Order and correct any input errors.

• If the Buyer fails to comply with the instructions for filling out the forms provided on the Site, as well as when entering inaccurate, incomplete and/or false information, the Order is considered inconsistent.

• The moment the offer is sent is considered the moment the Buyer sends the Order by filling out the appropriate form and clicking the “Confirm” button. Samilova Yu. N. confirms receipt of the Order by sending a corresponding letter to the email address specified by the Buyer. Confirmation of receipt of the Order does not constitute an offer, acceptance, confirmation of acceptance of the Order, or confirmation of the availability of the Goods.

• Acceptance of the Order occurs only after confirmation of the availability of the Goods in the warehouse of Yu.N. Samilova and sending the Buyer a corresponding email confirming acceptance of the Order. If the information about the Products displayed on the Site does not correspond to reality, as well as in other cases at the discretion of Yu.N. Samilova, Yu.N. Samilova reserves the right not to accept the Order and not to send an offer to the Buyer.

4. Payment for goods

4.1. Payment when ordering through the Website:

4.1.1. When Ordering through the Site, the Buyer’s clicking of the “Confirm” button is recognized as sending an offer to Yu.N. Samilov in relation to the Products selected by the Buyer, as well as confirmation of his agreement with these Rules.

4.1.2. Payment is made by the Buyer immediately after submitting the form by paying by credit card according to the electronic invoice issued on the payment page. Payment in cash or through payment terminals using alternative means of payment is not allowed.

4.1.3. When placing an Order through the Site, the funds payable for the Product are temporarily blocked in the Buyer’s bank account. The temporary blocking is lifted either at the time the funds are credited to Yu. N. Samilov’s bank account if the Order is accepted by Yu. N. Samilova for execution, or if Yu. N. Samilov discovers the impossibility of executing the Order and the impossibility of accepting the Buyer’s offer.

4.1.4. The moment of concluding a retail purchase and sale agreement and its entry into force is the moment of payment. The moment of payment is considered to be the moment of crediting funds to Yu.N. Samilov’s bank account. The moment of acceptance is considered to be Yu.N. Samilov’s sending to the Buyer of a cash receipt for the sale of the Goods. Temporary blocking of funds in the Buyer's bank account, as well as sending an invoice for an advance payment, is not considered the moment of payment.

4.1.5. The link to pay for the Order is valid for the time specified in the message containing the corresponding link.

5. Delivery of goods

5.1. Delivery of the Goods is carried out by a transport company recommended by Yu. N. Samilova.

5.2. The costs of standard delivery of the Goods are borne by the Buyer. The transfer of the Goods to the Transport Company for delivery to the Buyer is carried out only after the full cost of the Goods has been received into the bank account of Yu. N. Samilov. Standard delivery is carried out on weekdays from 9.00 to 18.00. Other delivery conditions are determined by Yu.N. Samilova and are brought to the attention of the Buyer by posting on the Site or by phone. If the Buyer wishes to order delivery on individual terms, such as delivery on Saturday or delivery on the day of the Order, the possibility and conditions of such delivery are determined by Yu. N. Samilova. The Buyer is warned that delivery on individual terms is not available for all regions of the Russian Federation Federation. The current list of regions in which such delivery is available must be clarified with Yu. N. Samilov immediately before placing the Order. Delivery costs on individual terms are borne by the Buyer.

5.3. Special delivery conditions: when Ordering Goods, the Buyer has the right to indicate that delivery must be made later than standard delivery times, or the delivery time will be determined later. If it is agreed that the delivery time will be determined later, the Buyer notifies Yu. N. Samilov about the delivery time by phone or email. Confirmation of the new delivery date is carried out by Yu. N. Samilova by email. The Buyer acknowledges that for such a delayed delivery period, Yu. N. Samilova provides the Buyer with storage services for the Goods, for which Yu. N. Samilova may charge a fee. The specific cost of storage services (or the absence of the need to pay for storage services) is agreed upon by the Parties in advance via email (Samilova Y. N. sends a confirmation message to the Buyer indicating the conditions and maximum storage period). Payment for storage services is made upon provision of services in accordance with the payment procedure established in these Rules. Samilova Yu. N. has the right to count the cost of the previously paid amount into the cost of payment for storage services and demand payment for the Goods up to the full amount.

5.4. Delivery of the Goods is carried out personally to the Buyer at the address specified by the Buyer in the Order. A representative of the Transport Company contacts the Buyer to clarify the place and time of delivery of the Goods. Simultaneously with the transfer of the Goods, the representative of the Transport company gives the Buyer a copy of these Rules, rules for caring for the Goods, as well as other information required to be provided in accordance with the current legislation of the Russian Federation.

5.5. At the Buyer's request, the Goods may be delivered to a third party. If an Order is placed by telephone, the Buyer undertakes to inform Yu. N. Samilov about this at the time of the Order. This person is indicated in the accompanying message as the Recipient and delivery is carried out to his address. If an Order is placed through the Site, the Buyer indicates the third party and address in the designated field of the Order form. Delivery of the Goods is carried out personally to the Buyer or other recipient specified in the Order, subject to their provision of an identification document.

5.6. By signing the courier's delivery sheet and the delivery form in person indicating the series and number of his passport at the time of delivery of the Order or self-pickup of the Order from Y. N. Samilova's store, the Buyer confirms that the Goods have been accepted, the external and internal packaging of the Goods are not damaged, and the Goods is in good condition, and also that he was provided with these Rules with full information about the timing and procedure for returning the Goods. If the Buyer refuses to sign the courier’s delivery sheet or refuses to accept the Goods, a representative of the Transport Company signs the sheet unilaterally indicating the Buyer’s refusal to sign/accept. In case of refusal to sign the delivery sheet, the Parties acknowledge that the Buyer duly accepted the Goods and no defects were found in the Goods. If the Buyer identifies shortcomings in the Goods upon acceptance, the Buyer indicates this on the delivery sheet. In case of refusal to accept the Goods, the Goods are returned by the Buyer in the manner specified in clause 8.4. Rules After completing the Order, the Buyer is sent a confirmation message by email.

5.7. Delivery is carried out by TC SDEK, Boxberry. Samilova Yu. N. does not make money on delivery, so delivery is paid by the client upon receipt of the parcel at the lowest rates. Shipments within Russia and the CIS countries are carried out by TC SDEK at the rates “to the warehouse” (from 210 rubles per parcel) and “to the door” (from 350 rubles per parcel). The average delivery time is 3-5 working days in Russia, depending on the remoteness of the destination. Payment for delivery is made upon receipt or when placing an order. Delivery time does not include order assembly time. The average order completion time is 7-10 working days, subject to availability of goods in stock.

7. Product quality guarantee

7.1. Samilova Yu. N. transfers to the buyer a product whose quality meets the generally required requirements and is suitable for the purposes for which a product of this kind is usually used.

7.2. The Buyer is warned that the warranty period for the Products is 30 calendar days. The warranty period for the product is calculated from the day the product is delivered to the consumer.

7.3. The Buyer is warned that if defects related to its quality are detected in the product, he has the right to make claims related to the quality of the product during the warranty period by sending a written request to the Seller’s location.

7.4. If defects in the product are discovered after the expiration of the warranty period related to its quality, the Buyer has the right to make claims related to the quality of the product if he proves that the defects in the product arose before its transfer to the consumer or for reasons that arose before that moment.

7.5. If the Buyer assumes that the product has defects and the warranty period has not expired, the Buyer sends the product to the Seller’s location to check the quality of the product in accordance with Section 8 of the Rules after receiving a response from the Seller about the possibility of accepting the product for quality check.

7.6. The procedure for checking the quality of goods is established by these Rules.

7.7. The quality of the goods is checked by Samilov Yu. N. inspecting the goods, testing, and analysis. The period for checking the quality of goods cannot exceed 45 days.

7.8. Checking the quality of goods may include an examination of the goods by a specialized organization recommended by Yu. N. Samilova. The examination of the goods is carried out within a period not exceeding 45 days

7.9. If, as a result of the examination of the goods, it is established that its defects arose due to circumstances for which Yu. N. Samilova is not responsible, or the defects of the goods are not identified, the Buyer is obliged to reimburse the costs of the examination, as well as the costs associated with its conduct for storage and transportation of the goods .

8. Return of goods

8.1. The Buyer has the right to refuse Goods of proper quality at any time before its transfer and after its transfer - within 7 calendar days, provided that its marketable appearance and consumer properties are preserved, and also provided that the Buyer has retained a document confirming the fact and conditions purchase of the specified Product. Subject to the provisions of Art. 8.2. Goods of proper quality must be delivered to Yu. N. Samilov before the expiration of 7 calendar days from the date of its receipt by the Buyer. Refusal of Goods of inadequate quality is possible within the warranty period of the Goods established in clause 7.2.

8.2. The refund of the amount paid by the Buyer is carried out no later than 10 (ten) calendar days from the date the Buyer submits the relevant request. The date of the Buyer's request for return is the date of receipt of the returned Goods by Yu.

8.3. The amount paid by him is returned to the Buyer in the same way as payment for the Goods was made. When paying by bank card, the refund is made by transferring the paid amount to the Buyer's bank card from which payment for the Goods was made. When paying to the bank account of Yu. N. Samilov, the refund is made by transferring funds to the Buyer's bank account from which payment for the Goods was made.

8.4. The return of the Goods is carried out by the Transport Company. If the Buyer wishes to refuse the Product (regardless of whether it is of adequate or inadequate quality), the return is carried out by submitting an application to the customer center of Yu.N. Samilova in accordance with clause 1.5.1. of the Rules, which fills out an application for cargo collection and sends it to a representative of the Transport Company, who agrees with the Buyer on the date and other conditions of collection. Coordination is carried out by phone and email.

8.5. The costs of returning the Goods of proper quality are borne by the Buyer. The costs of returning Goods of inadequate quality are borne by the Seller. If, after checking the quality of the goods, it is determined that the defects arose due to circumstances for which Yu.N. Samilova is not responsible, or the defects of the goods are not identified, the Buyer is obliged to reimburse the costs of returning the goods.

8.6. Return of Goods of proper or inadequate quality is possible only if they were originally purchased by contacting the customer center through the Site.

8.7. The buyer is warned that in accordance with Decree of the Government of the Russian Federation dated December 31, 2020 N 2463, textile goods (cotton, linen, silk, wool and synthetic fabrics, goods made from non-woven materials such as fabrics - ribbons, braid, lace), garments and knitted underwear, Hosiery items cannot be returned or exchanged.

9. Responsibility of IP Samilova Yu. N.

9.1. The Buyer's data provided when placing an Order is considered reliable, belonging to the person who contacted the customer center, placed an Order on the Site, and will be further used to communicate and confirm the terms of the Order and delivery. If the email address changes, the Buyer undertakes to immediately notify the customer center by phone.

9.3. By agreeing to these Rules, the Buyer confirms that he has been warned and assumes the risks of adverse consequences associated with the transfer of access to his electronic mailbox to third parties, as well as those associated with the communication by Samilova Yu. N. of unreliable contact information, including email address .

9.4. Samilova Yu. N. takes technical and organizational measures to ensure the protection of services on the Site, the safety of data and electronic messages in order to prevent unauthorized use or access to data, as well as to prevent the risk of distribution, destruction or loss of data and information relating to users of the Site, and to prevent unauthorized or unlawful access to such data and information. However, the nature of the Internet and web content may not allow the Site to operate without interference, interruption, or interruption due to the Site update process. Samilova Yu. N. cannot guarantee that the Site will operate continuously, without interruptions and errors related to the Internet connection. Samilova Yu. N. does not make any guarantees regarding the accuracy, suitability, reliability, completeness, performance, absence of viruses or timeliness of the content or services on the Site.

9.5. If the Buyer's prolonged inactivity leads to the loss of the Internet connection to the Site, information about the Buyer's choice of Products may be lost. In this case, the Buyer will need to reselect the Products.

9.6. Samilova Yu. N. is not responsible for any losses (including lost profits) that may arise during the use or delay/inability to use the Site, its content or any link to another website, except for liability expressly provided by law.

9.7. The Buyer is warned that independently organizing the delivery of the Goods, including by contacting other transport companies not provided for by these Rules, does not guarantee the safety of the Goods and its proper delivery to the addressee. When using the services of other courier services, the Buyer is solely responsible for the proper fulfillment of their obligations by such services.

10. Special conditions

10.1. Orders by phone/email or on the Website from legal entities and individual entrepreneurs are not accepted. If it is discovered that the Order was placed by an individual in favor of a legal entity, of which Samilova Yu.N. was not informed at the stage of placing the Order, such Order is subject to cancellation by Samilova Yu.N., and the funds, if any, upon discovery, are subject to return to Yu. N. Samilov within 5 (Five) working days from the date of cancellation of the Order.

10.2. By submitting an Order, the Buyer gives Yu. N. Samilova consent to the processing of his personal data, including cross-border data transfer in the amount and under the conditions provided for by the Public Policy for the processing of Yu. N. Samilova’s personal data, in the version posted on the Site at the time the Buyer provides personal data data. The buyer also gives consent to Samilov Yu.N. to communicate through the specified contact information advertising information about Samilov Yu.N., his goods and services. If it is necessary to obtain the written consent of the Buyer, such consent is considered received when signing it with a simple electronic signature, when sending information through selected forms on the pages of the Site, by entering a unique login / password pair by the Buyer, and clicking on the submit button of the form, or, in relation to forms for filling out which does not require creating a login and password, by entering the unique pair Buyer's Full Name / Buyer's Phone Number by the Buyer and clicking on the submit button.

10.3. Samilova Yu. N. does not collect or store the Buyer’s payment information (including bank card number, bank card issuing bank, expiration date, secret code, etc.) when paying for the Goods with a bank card.

10.4. All disputes and disagreements that may arise between the Parties on issues related to the conclusion, execution and termination of the retail purchase and sale agreement will be resolved through negotiations based on the current legislation of the Russian Federation. Disputes not resolved during the negotiation process are resolved in court in the manner established by the current legislation of the Russian Federation.

10.5. All claims related to the conclusion, execution or termination of a retail purchase and sale agreement are accepted by Y. N. Samilova at the address specified in these Rules.
